45-year-old Swindon man accused of assaulting and raping woman in violent attack

A man has appeared in court accused of raping a woman while she pretended to be asleep.

Colin Kelly Davies, 45, was arrested when Wiltshire Police were called to an address in Swindon earlier this week following concerns raised about the welfare of a woman.

The defendant, who updated his address from no fixed abode to a family member’s address in Wolsely Avenue, Park South, appeared at Swindon Magistrates’ Court today (11 March).

Prosecutor Keith Ballinger said the alleged victim – who had a black eye – disclosed an assault to a third party when they visited the address, who reported their concerns.

The police were tasked with investigating, and when officers arrived they found the alleged victim and Davies together. But with the defendant present, she claimed there was no assault.

Davies was arrested and once he was taken out of the house, she opened up – telling the officers that he violently assaulted her while she pretended to be asleep, before carrying out the rape.

During the assault, he is accused of holding her throat, punching, headbutting and slapping her.

Davies indicated not guilty pleas, denying the allegations.

Describing the allegations of assault and rape as “very serious”, magistrates remanded him into custody to next appear at Swindon Crown Court in April.
